1. Our Services

Information provided through the Services isn't meant for distribution where doing so would violate local laws or regulations.

2. Intellectual Property Rights

Our intellectual property

The company owns all intellectual property in the Services, including source code, databases, software, website designs, audio, video, text, photographs, graphics, trademarks, service marks and logos. This content is protected under copyright and trademark laws internationally.

Your use of our Services

Subject to compliance with these terms, you receive a non-exclusive, non-transferable, revocable license to access the Services and download content for personal, non-commercial use only.

No part of the Services may be reproduced, republished, distributed or exploited commercially without express written permission from info@banbanjara.com.

Your submissions

Content you submit to the company becomes its property for unrestricted lawful use. You confirm submissions don't violate laws, contain original material and grant the company full rights to use them.

3. User Representations

Users represent that they have legal capacity, comply with these terms, are at least 18 years old, will not use automated access and will not violate applicable laws. The company may suspend accounts providing false information.

4. Purchases and Payment

The company accepts Razorpay, UPI and Mastercard. You must provide accurate purchase and account information, authorizing charges to your payment method. Prices may change at any time and all charges are in INR. The company reserves the right to refuse orders or limit quantities.

5. Policy

All sales are final and no refund will be issued.

6. Prohibited Activities

Users cannot systematically retrieve data, defraud others, interfere with security features, use information to harm others, submit false abuse reports, violate laws, frame or link improperly to the Services, upload malware, engage in automated use, impersonate others, interfere with operations, harass employees, bypass access measures, copy or reverse-engineer software, use unauthorized scripts, employ purchasing agents or collect user information for spam.

7. User Generated Contributions

While the Services generally don't accept user submissions, any Contributions must not infringe third-party rights, contain false information, constitute unsolicited advertising, be obscene or harassing, ridicule anyone, violate privacy rights, involve child protection violations or contain offensive comments related to race, gender or other protected characteristics.

8. Contribution License

The company may access, store and use any information or data provided by users. Users retain ownership of Contributions but grant the company rights to use feedback without compensation.

9. Third-Party Websites and Content

The company doesn't monitor third-party websites or content linked through the Services and assumes no responsibility for them. Users access such sites at their own risk, and the company doesn't endorse third-party products or services.

10. Services Management

The company reserves the right to monitor for violations, take legal action, refuse access, disable Contributions, remove excessive files and manage the Services to protect its rights.

11. Privacy Policy

Users agree to be bound by the Privacy Policy. The Services are hosted in India; users consent to data transfer there.

12. Term and Termination

The company reserves the right to deny access without notice or liability for any reason. Terminated users cannot create new accounts under any name. The company may pursue legal action beyond account termination.

13. Modifications and Interruptions

The company may change, modify or remove Services content at any time without notice or obligation to update information. It reserves the right to modify or discontinue all or part of the Services without liability for downtime or service interruptions.

14. Governing Law

These terms follow Indian law, with Jaipur courts having exclusive jurisdiction over disputes.

15. Dispute Resolution

Informal Negotiations

Parties first attempt informal dispute resolution for a specified period before arbitration.

Binding Arbitration

Disputes shall be resolved through the International Commercial Arbitration Court under the European Arbitration Chamber (Belgium, Brussels, Avenue Louise, 146) according to its Rules. The seat of arbitration is India, with substantive law being Indian law.

Restrictions

Arbitration is limited to individual disputes; class-action proceedings and representative claims are prohibited.

Exceptions to Informal Negotiations and Arbitration

Intellectual property disputes, allegations of theft or piracy, privacy violations and injunctive relief claims aren't subject to these provisions and may be brought in competent courts.

16. Corrections

The company reserves the right to correct typographical errors, inaccuracies or omissions and update information at any time without notice.

17. Disclaimer

The Services are provided on an as-is and as-available basis. The company disclaims all warranties regarding Services accuracy and completeness. It assumes no liability for errors, personal injury, property damage, unauthorized access, transmission interruptions, malware or content-related losses resulting from Services use.

18. Limitations of Liability

The company and its representatives won't be liable for direct, indirect, consequential, exemplary, incidental, special or punitive damages, including lost profit or data, arising from Services use.

19. Indemnification

Users agree to defend and indemnify the company from losses or claims arising from Services use, term breaches, representation violations, third-party rights violations or harmful acts toward other users.

20. User Data

The company maintains certain transmitted data but isn't liable for loss or corruption. Users bear sole responsibility for their data and waive action rights against the company.

21. Electronic Communications, Transactions and Signatures

Users consent to electronic communications and agree that all agreements, notices, disclosures and other communications delivered electronically satisfy legal writing requirements. Users waive signature and non-electronic record requirements.

22. Miscellaneous

These terms constitute the entire agreement. The company's failure to enforce provisions doesn't waive them. The company may assign rights and obligations at any time. If provisions prove unenforceable, remaining terms remain valid.
